    1. Agreement to Terms
    By accessing or using Floma ("the Software"), you agree to these Terms of Service ("Terms"). If you disagree with any part, you may not use Floma.
    2. Description of Service
    Floma is a command-line automation tool that:
    
      - Runs locally on your computer
 
      - Automates file operations, data processing, and workflows
 
      - Integrates with third-party services (optional)
 
      - Uses AI for intelligent task planning (when configured)
 
    
    3. License Grant
    3.1 Free Version
    The free version is provided "as-is" with limited features. You may use it for personal or commercial purposes with the following restrictions:
    
      - 5 AI extractions per month
 
      - 5 emails per month
 
      - Unlimited file operations
 
      - No commercial support
 
    
    3.2 Paid Subscription
    Paid subscriptions grant you a non-exclusive, non-transferable license to use Floma with enhanced features:
    
      - Personal ($12.99/month): 75 AI extractions, 50 emails, advanced features
 
      - Pro ($29.99/month): Unlimited AI extractions, unlimited emails, all features
 
    
    3.3 License Restrictions
    
      - One machine per license: Each license activates on one computer only
 
      - No sharing: You may not share your license key
 
      - No reselling: You may not resell, sublicense, or distribute Floma
 
      - No reverse engineering: You may not decompile or reverse engineer the software
 
    
    4. Subscription and Payment
    4.1 Billing
    
      - Subscriptions are billed monthly in advance
 
      - Payment processed securely via Stripe
 
      - Prices are in USD unless otherwise stated
 
      - All sales are final (no refunds except as required by law)
 
    
    4.2 Auto-Renewal
    
      - Subscriptions automatically renew each month
 
      - You will be charged on the same day each month
 
      - You can cancel anytime through your Stripe customer portal
 
      - Cancellations take effect at the end of the current billing period
 
    
    4.3 Failed Payments
    
      - If payment fails, we'll retry up to 3 times over 2 weeks
 
      - If payment still fails, your subscription will be cancelled
 
      - You'll receive email notifications before cancellation
 
    
    4.4 Refunds
    
      - No refunds for partial months
 
      - No refunds if subscription is cancelled mid-month (you retain access until period ends)
 
      - Refunds may be issued at our discretion for service outages or errors
 
    
    5. Acceptable Use
    5.1 Permitted Uses
    You may use Floma for:
    
      - Personal automation and productivity
 
      - Business workflow automation
 
      - Data processing and file management
 
      - Integration with third-party services you control
 
    
    5.2 Prohibited Uses
    You may NOT use Floma to:
    
      - Violate any laws or regulations
 
      - Infringe on intellectual property rights
 
      - Send spam or unsolicited communications
 
      - Scrape websites that prohibit automated access
 
      - Process illegal content or data
 
      - Attack, hack, or compromise systems or networks
 
      - Circumvent usage limits or licensing restrictions
 
      - Resell or redistribute the software
 
    
    5.3 Consequences of Violations
    Violations may result in:
    
      - Immediate license revocation
 
      - Subscription cancellation without refund
 
      - Legal action
 
      - Reporting to appropriate authorities
 
    
    6. Third-Party Services
    Floma integrates with third-party services:
    
      - Anthropic Claude: AI processing (requires your API key)
 
      - Email providers: Sending emails (requires configuration)
 
      - Slack: Notifications (requires OAuth)
 
      - Webhooks: External integrations
 
    
    Your use of these services is subject to their own terms and conditions. We are not responsible for third-party service availability or actions.
    7. Intellectual Property
    7.1 Our IP
    Floma, including all code, documentation, and branding, is owned by us and protected by copyright and other intellectual property laws.
    7.2 Your Content
    You retain all rights to:
    
      - Files you process with Floma
 
      - Workflows you create
 
      - Data you input or generate
 
    
    We do not claim ownership of your content.
    7.3 Feedback
    If you provide feedback, suggestions, or ideas, we may use them freely without compensation or obligation to you.
    8. Privacy and Data
    Our Privacy Policy explains how we handle your data. Key points:
    
      - Floma runs locally - your files stay on your computer
 
      - We only collect minimal data (email, license info, payment data)
 
      - We never access or process your files
 
      - Third-party integrations may send data externally (your choice)
 
    
    9. Disclaimer of Warranties
    FLOMA IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
    We disclaim all warranties, express or implied, including:
    
      - Merchantability and fitness for a particular purpose
 
      - Non-infringement
 
      - Uninterrupted or error-free operation
 
      - Accuracy or reliability of results
 
      - Data loss prevention
 
    
    10. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW:
    
      - We are not liable for any damages arising from use of Floma
 
      - This includes direct, indirect, incidental, consequential, or punitive damages
 
      - Our total liability is limited to the amount you paid in the last 12 months (max $360)
 
      - We are not liable for data loss, business interruption, or lost profits
 
    
    11. Indemnification
    You agree to indemnify and hold us harmless from claims arising from:
    
      - Your use of Floma
 
      - Your violation of these Terms
 
      - Your violation of third-party rights
 
      - Your violation of applicable laws
 
    
    12. Updates and Changes
    12.1 Software Updates
    
      - We may release updates, patches, or new versions
 
      - Updates may be automatic or manual
 
      - We may discontinue support for old versions
 
      - New features may be added or removed
 
    
    12.2 Terms Updates
    
      - We may modify these Terms at any time
 
      - Changes will be posted with an updated date
 
      - Continued use after changes constitutes acceptance
 
      - Material changes will be communicated via email
 
    
    12.3 Price Changes
    
      - We may change subscription prices
 
      - Price changes apply to new subscribers immediately
 
      - Existing subscribers receive 30 days notice

    13. Termination
    13.1 Your Right to Terminate
    You may cancel your subscription anytime through the Stripe customer portal. Cancellation takes effect at the end of your billing period.
    13.2 Our Right to Terminate
    We may suspend or terminate your access if:
    
      - You violate these Terms
 
      - Payment fails repeatedly
 
      - We suspect fraudulent activity
 
      - Required by law
 
    
    13.3 Effect of Termination
    
      - Your license is revoked
 
      - You must stop using Floma
 
      - No refund for unused time
 
      - Local data remains on your computer (you may delete it)
 
    
    14. Dispute Resolution
    14.1 Informal Resolution
    Before filing any claim, contact us at support@getfloma.com to resolve disputes informally.
    14.2 Governing Law
    These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.
    14.3 Arbitration
    Any disputes will be resolved through binding arbitration in Delaware, except:
    
      - Small claims court disputes (under $10,000)
 
      - Intellectual property disputes
 
    
    14.4 Class Action Waiver
    You agree to resolve disputes individually. No class actions or representative proceedings.
    15. Miscellaneous
    15.1 Entire Agreement
    These Terms and our Privacy Policy constitute the entire agreement between you and us.
    15.2 Severability
    If any provision is found unenforceable, the remaining provisions remain in effect.
    15.3 No Waiver
    Failure to enforce any right does not waive that right.
    15.4 Assignment
    You may not assign these Terms. We may assign them without notice.
    15.5 Force Majeure
    We're not liable for delays or failures due to circumstances beyond our control.
